Carta al Secretario General de las Naciones Unidas,

Asunto: Un llamado a dirigirse urgentemente a las autoridades de Baréin para que liberen a todos los presos de conciencia y permitan que los relatores de la ONU los visiten

En la declaración emitida por la Oficina del Alto Comisionado para los Derechos Humanos, la Sra. Michelle Bachelet el 25 de marzo de 2020, expresó su grave preocupación por el hacinamiento en las cárceles en varios países del mundo. La compleja situación de suciedad e insalubridad. Condiciones en las que residen muchos reclusos[1], lo que actualmente es un factor agravante en la propagación del coronavirus, y se solicitó la liberación del mayor número posible de presos como medida decisiva para limitar la propagación del Covid-19.[2]

A raíz de que el número de casos infectados llegó a 114 debido a que las fuerzas de seguridad de la Cárcel de Jau Central no anunciaron al inicio los casos, entregando de manera no transparente la información de los primeros 3 casos, el detalle del número total de casos, y el debido inicio de la localización de contactos, y como resultado de las reiteradas quejas recibidas por los presos y sus familias sobre las malas condiciones carcelarias,[3] incluida la falta de cantidades adecuadas de alimentos en la primera semana de la declaración de varios infectados por COVID-19. Todo esto, a la luz del hacinamiento en las cárceles de Baréin, especialmente porque hay un gran número de presos de conciencia detenidos por motivos arbitrarios relacionados con la libertad de expresión; y dada la falta de confianza en los estándares de atención médica dentro de la prisión: le imploramos que se dirija con urgencia a las autoridades de Baréin y pida la liberación de todos los presos de conciencia, y permita que el Relator Especial de las Naciones Unidas sobre la Tortura y Tratos Crueles, Inhumanos o Degradantes pueda visitar Baréin y controlar las condiciones de la prisión e investigar la muerte de la víctima de tortura y negligencia médica, Abbas Mal Allah.[4]

 

 

Nosotros, los signatarios de este memorando, la invitamos a dirigirse urgentemente a las autoridades de Baréin y pedir la liberación de todos los presos de conciencia; pedir que el relator especial de las Naciones Unidas sobre la tortura y otros tratos o penas crueles, inhumanos o degradantes visite Baréin para vigilar las condiciones carcelarias e investigar la muerte de la víctima de tortura y negligencia médica, Abbas Mal Allah.

La forma más grave de tortura y malos tratos en los últimos años que se ha detectado en las cárceles es la "negación de atención médica". Desde enero de 2018 hasta el 15 de marzo de 2021, se registraron 776 casos de violaciones al derecho a recibir el tratamiento médico adecuado y necesario.[5]

El deterioro de las condiciones carcelarias en casos anteriores ha provocado muchas quejas y ha dado lugar a diversas protestas que exigen a las administraciones penitenciarias el cumplimiento de las normas mínimas para el tratamiento de los presos. Las más destacadas de estas protestas fueron los disturbios en la prisión de Dry Dock en 2013 y los disturbios en la prisión de Jaw Central en 2015.

En casos anteriores, el deterioro de las condiciones carcelarias había suscitado numerosas denuncias que dieron lugar a numerosas protestas exigiendo a la administración penitenciaria que cumpliera las normas mínimas para el tratamiento de sus presos. La más destacada de estas protestas tuvo lugar en 2013 en la prisión Hidd y en 2015 en la prisión central de Jau.

Las organizaciones han señalado que la liberación de presos a la luz de la pandemia COVID-19 es menor y más lenta de lo que debería: la liberación de ((X)) casos de presos de conciencia se registran desde marzo de 2020. Entre esos casos, muchos ya habían terminado sus condenas antes de su liberación.
