Organizzazioni in difesa dei diritti umani richiedono una sessione urgente dell’Assemblea generale dell’Onu

In base alla decisione “Unirsi per la Pace” e per la formazione di una Corte penale internazionale straordinaria

 

Dal 7 di ottobre, lo Stato di occupazione e apartheid conduce una guerra senza controlli o restrizioni legali e morali, commettendo molteplici crimini internazionali senza esitare nell’utilizzo di armi vietate dalla legge internazionale. Dimostra un flagrante disprezzo dei principi fondamentali del diritto umanitario internazionale e dei diritti umani internazionali, con violazioni giornaliere. Le sue gravi violazioni del diritto internazionale ignorano qualsiasi principio o regola internazionale. In questa situazione, gli Stati uniti d’America sostengono l’aggressione con l’invio della sua flotta militare nella regione; inoltre, l’Unione europea incoraggia l’aggressione scegliendo un silenzio assordante al riguardo dei crimini di Israele, inaccettabile sia dal punto di vista legale che morale. Il Consiglio di Sicurezza, a sua volta, rimane paralizzato e incapace di adoperare le sue responsabilità istituzionali nonostante le gravi violazioni del diritto pubblico internazionale, la Carta delle Nazione Unite, i diritti umani, e la giurisprudenza internazionale umanitaria; le quali minano chiaramente alla pace e sicurezza internazionale.

 

Ci troviamo di fronte alla continua perpetuazione di crimini internazionali da parte della forza occupante; in questo citiamo il crimine del genocidio, Articolo 6 dello Statuto di Roma, crimini di guerra, Articolo 8, un crimine contro l’umanità, Articolo 7, e il crimine d’aggressione, Articolo 5, contro il popolo palestinese nella Striscia di Gaza. In vista del silenzio del Consiglio di Sicurezza e delle Nazioni unite di fronte a questi crimini, e del nostro impegno nella difesa dei diritti umani violati quotidianamente durante l’occupazione illegale della Palestina, richiediamo dal Segretario generale dell’ONU una condanna chiara di Israele e dei suoi crimini, e facciamo urgentemente appello alle misure umanitarie richieste per proteggere i civili a Gaza. Finalmente, in vista alla paralizzazione del Consiglio di sicurezza, chiediamo al Segretario generale di indire una sessione urgente basata sulla risoluzione "Unirsi per la Pace" per discutere la situazione nella Striscia di Gaza e nei territori palestinesi occupati, ed a adottare le seguenti misure:

 

Primo: Lavorare con urgenza alla cessazione dell’aggressione di Israele a Gaza, condannando i crimini dello Stato di occupazione e apartheid, e la sua continua aggressione contro la Striscia di Gaza, e considerarlo ufficialmente una minaccia alla sicurezza e alla pace nella regione;

 

Secondo: Sottolineare il diritto del popolo palestinese all’autodeterminazione e alla libertà, il diritto al ritorno alle loro terre, e il loro diritto alla resistenza, compresa la lotta armata, contro l’occupazione.

 

Terzo: La formazione di una corte penale internazionale straordinaria, il cui compito esclusivo sia perseguire in giustizia i responsabili di crimini di guerra, crimini contro l’umanità, nonché i dirigenti Israeliani e gli individui che abbiano ordinato l’attuazione di questi crimini.

 

Quarto: sottolineare che la forza occupante non ha il diritto all'autodifesa perché è un occupante; un occupante non ha il diritto di usare l'autodifesa di fronte a una situazione che ha provocato con la sua palese occupazione e continua aggressione contro il popolo palestinese e la negazione del suo diritto all'autodeterminazione.

 

Quinto: Richiedere a tutti gli Stati della comunità internazionale di adempiere ai loro obblighi e responsabilità legali e di lavorare per fermare i crimini di guerra e contro l’umanità della forza occupante contro i residenti della Striscia di Gaza; di lavorare responsabilmente per porre immediatamente fine all'aggressione contro di essa e contro i civili, i bambini, le donne e gli anziani, che vengono uccisi a centinaia da decine di aerei in un processo di genocidio senza precedenti, che rappresenta un tentativo di sfollare nuovamente i palestinesi da Gaza; porre fine all'assedio imposto alla Striscia di Gaza e fornire immediatamente la necessaria assistenza finanziaria e umanitaria alla popolazione e fornire loro ciò che garantisca le loro esigenze di vita, mediche e umanitarie; e fermare immediatamente gli attacchi dei coloni pesantemente armati e dell'esercito israeliano di occupazione contro le donne e gli uomini palestinesi in Cisgiordania e intraprendere un'azione speciale per proteggere i prigionieri palestinesi nelle carceri sioniste, che sono sottoposti a brutali rappresaglie al di fuori di ogni legge, obbligo e principio di moralità.

 

Sesto: ritenere legalmente responsabili tutti coloro che hanno sostenuto o incoraggiato la forza occupante a commettere i suoi orribili crimini, siano essi di altri Stati o dirigenti di altri Stati.

 

In conclusione, ricordiamo alle Nazioni Unite che la loro responsabilità nei confronti della Palestina, ai sensi del diritto internazionale, e dell'esercizio da parte del popolo palestinese del suo pieno diritto all'autodeterminazione, esiste ancora, secondo il parere consultivo della Corte internazionale di giustizia sul muro di separazione del 2004. Chiediamo inoltre di attivare e sviluppare il lavoro del Comitato delle Nazioni Unite che si occupa dell'esercizio dei diritti inalienabili del popolo palestinese.
